01.Agreement to Terms & Company Relationship

These Terms of Service constitute a legally binding agreement between you and Oahu Autoshop LLC ("Company," "we," "us," or "our"), governing your access to and use of the Fixcars.ai software, website, and mobile applications distributed via the Apple App Store and Google Play Store.

By downloading, installing, accessing, or using Fixcars.ai, you agree to be bound by these Terms of Service and the Apple Standard End User License Agreement (EULA) located at Apple Standard EULA. You acknowledge that these Terms are concluded between you and Oahu Autoshop LLC only, and not with Apple, Inc. Oahu Autoshop LLC, not Apple, is solely responsible for Fixcars.ai and the content thereof.

03. User-Generated Content & Zero Tolerance Policy

Fixcars.ai provides community repair discussions and mechanic exchange boards. Oahu Autoshop LLC enforces a strict Zero Tolerance Policy for objectionable content and abusive users:

• No harassment, defamation, hate speech, bullying, discrimination, or intimidation.
• No sexually explicit, violent, obscene, or unlawful content.
• No distribution of fraudulent diagnostic claims, commercial spam, or malicious software.

Any user violating these rules will have offending content removed immediately and their account subjected to temporary suspension or permanent termination without prior notice.

04. Content Reporting, Moderation & User Blocking

In full compliance with App Store review guidelines for applications featuring user-generated content:

• In-App Reporting:You can report any post, diagnostic note, or comment by tapping the options menu ("Report Content").
• User Blocking:You can block any offending user immediately ("Block User"), which immediately conceals all current and future content from that user.
• 24-Hour Review Window: All reported content is reviewed by Oahu Autoshop LLC moderation personnel within 24 hours. Objectionable content will be permanently purged and offending accounts banned.

05.PRO Passes, Subscriptions & Billing

Guests can run 3 free AI diagnoses. A free account includes 3 AI diagnoses plus 10 follow-up chat messages per day. PRO removes these limits (fair-use rate limits still apply). Current limits and prices are always shown in the app and at checkout, and may change over time.

06. Community Points & Rewards

• You can earn reputation points for community activity, such as helpful posts and answers, votes from other members, daily check-ins, and referrals. Points can also be deducted, for example when your content is voted unhelpful.
• Points can be redeemed for the rewards listed in the app, such as a PRO discount, an expert badge request, or extra diagnoses. Points have no cash value and cannot be bought, sold, or transferred.
• We may remove points or rewards obtained through abuse, fraud, vote manipulation, or self-referrals, and we may change or end the program. Points and unused rewards are lost when your account is deleted.

07.Account Deletion & Data Rights

You can delete your Fixcars.ai account at any time in the mobile app (Profile → Delete Account → type DELETE to confirm; your password is also required for email accounts), or request deletion through our Account Deletion Portal, which our team processes within 24 to 48 business hours. Deletion permanently erases your saved virtual garage, diagnostic transcripts, community content, and authentication profile, as described in our Privacy Policy.

08.Apple App Store Additional Terms

If you downloaded Fixcars.ai from the Apple App Store, the following terms apply:

• Agreement with Oahu Autoshop LLC Only: These Terms are between you and Oahu Autoshop LLC, not Apple. Apple is not responsible for Fixcars.ai or its content.
• Scope of License: The license granted to you is limited to a non-transferable license to use Fixcars.ai on Apple-branded products running iOS/iPadOS that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance & Support: Oahu Autoshop LLC is solely responsible for providing maintenance and support services for Fixcars.ai. Apple has no obligation whatsoever to furnish any maintenance or support services.
• Warranty: In the event of any failure of Fixcars.ai to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to Fixcars.ai.
• Product Claims: Oahu Autoshop LLC, not Apple, is responsible for addressing any claims by you or a third party relating to Fixcars.ai or your possession and use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws.
• Intellectual Property:If a third party claims that Fixcars.ai or your possession and use of it infringes that party's intellectual property rights, Oahu Autoshop LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
• Legal Compliance:You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Terms: You must comply with any applicable third-party terms (for example, your wireless data service agreement) when using Fixcars.ai.
• Third-Party Beneficiary:Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
